New York City Ladder and Scaffold Construction Accidents

New York City Ladder and Scaffold Construction Accidents

Construction Site Accidents

If you were injured while working on a construction site, you may be entitled to compensation. Construction site accidents often involve falling from a height while working on elevated surfaces like a scaffold or ladder.  Too often, the ladder or scaffold fails, causing the construction worker to fall from a height and be seriously injured resulting in significant lost time from work.

Injured construction workers should only hire a New York City accident lawyer who is well-versed in construction-worker safety, including the requirements of the New York State Labor Law and Industrial Code as well as OSHA.

New York State Labor Law Requirements

Generally speaking, the New York State Labor Law requires construction site owners and general contractors to provide construction site workers with adequate safety equipment to prevent gravity-related injuries.

New York Labor Law Section 240, known as “The Scaffold Law,” places absolute liability upon owners and general contractors who fail to provide construction workers with the safety equipment necessary to prevent injuries caused by falling construction objects or falls from a height.

For example, if a construction worker is injured from falling off an inadequate ladder or scaffold, he or she can sue the construction site owner and general contractor for money damages; if a construction worker is injured by falling construction materials, he or she can also sue the construction site owner and general contractor for money damages.

In November and December 2015, Blake G. Goldfarb represented a Bronx ironworker whose safety harness failed to prevent him from falling several stories when temporary flooring collapsed under his feet, causing him to fall several stories onto his back which required surgery.

The construction site owner and general contractor were found 100% responsible for the accident.  After a jury trial on the issue of damages, Blake G. Goldfarb helped his injured client obtain over $5 million in compensation from a Bronx jury.  The jury’s damages award was the 25th highest verdict in all of New York State for the year 2015.
