What to do if you are injured in a New York slip/trip-and-fall accident:

1. Document your accident by:

  • Taking photographs and/or videos of the scene of the accident, your clothing and shoes and of your physical injuries like cuts, bruises, stitches, scarring, casts, crutches
  • Getting witness information, including names, addresses and phone numbers
  • Calling an ambulance, if you require it, and/or calling the police – which will document when/where/why your accident occurred and serve as contemporaneous proof of your injuries

  • Making a report – if your accident occurred in a store, ask the manager to make a report and ask for a copy of it before you leave
  • Saving the item that caused you to fall as well as the shoes and clothing you were wearing at the time of your accident

2. Seek necessary medical attention as soon as possible

3. If medically necessary, have your doctor refer you for objective medical testing like MRI(s), X-ray(s), CT scan(s) and/or EMG(s) nerve conduction studies, which serve as proof of the nature and extent of your injuries

4. Report your accident to the person or company in charge of the property as soon as it happens

5. Be careful what you say after the accident – particularly with respect to what caused your accident

6. Consult with a qualified personal injury attorney as soon as possible.  Strict time limitations may apply to your claims (for example, if you were injured on a city sidewalk adjacent to a one, two or three-family home which is owner-occupied in whole or in part and used exclusively for residential purposes, then you must file a Notice of Claim with the City of New York within 90 days of your accident)

Throughout the process, all evidence must follow court rules and all documents submitted to the court must be in the correct format and include relevant legal documentation.
