What to do if you are injured in a New York car accident:

  1. Call the police and get an accident report
  2. Get the license plate number(s) and insurance information of the car(s) involved

  3. At the scene, and if your injuries permit, get witness information, including name(s) and contact information, as well as photographs of the accident scene and car(s) involved
  4. Call an ambulance, if you require it, and seek necessary medical attention as soon as possible — the longer you wait to seek medical attention, the harder it will be to prove that your injuries are as a result of the car accident
  5. If medically necessary, have your doctor refer you for objective medical testing like MRI(s), X-ray(s), CT scan(s) and/or EMG(s) nerve conduction studies — the results of which can constitute proof that you suffered a “serious injury,” which is required in New York to have a successful car-accident lawsuit and receive monetary compensation outside of the no-fault system
  6. Within 30 days of your accident, complete and file a New York application for motor vehicle no-fault benefits — which applies to any cyclist, pedestrian, passenger or driver injured by a motor vehicle in New York
  7. Save all of your medical bills and receipts, gather proof of your financial losses like lost wages and opportunities and keep track of your out-of-pocket expenses for things like medications, travel to/from medical appointments and the cost of medical supplies
  8. Consult with a qualified personal injury attorney as soon as possible because strict time limitations may apply to your claims (for example, if a vehicle involved in your accident is owned or operated by the City of New York or New York City Transit Authority, you must file a Notice of Claim within 90 days of your accident)
